Terms of Sale: Pursuant to judgment entered in proceedings in Case #06-CH-19 in the Tenth Judicial Circuit Court of Putnam County, Illinois, the following real estate will sell at public auction: 

The South Half of Section 11 and the West 20 acres of the Southwest Quarter of Section 12, all in Township 31 North, Range 1 West of the Third Principal Meridian, except the coal underlying said premises together with the right to mind and remove the same through underground passages, and excepting that part thereof described as follows, to-wit: 

A part of the Southwest Quarter of Section 11, Township 31 North, Range 1 West of the Third Principal Meridian more particularly described as follows:

Beginning at a point on the South line of said Quarter Section 235 feet East of the Southwest Corner thereof, thence North 271 feet, thence East 250 feet, thence South 271 feet to the said South line thence West 250 feet to the place of beginning, situated in  Putnam County, Illinois; and also excepting therefrom the West 71.900 acres of the West Half of the Southwest Quarter of Section 11. The tract herein described is commonly known as the Sutherland Farms, the street address being 4150 East 147th Street, McNabb, Illinois 61335.

The property shall be sold to the highest and best bidder on December 18, 2007, at 10 a.m. in the circuit courtroom, 2nd floor of the Putnam County Courthouse, 120 N. Fourth Street, Hennepin, Illinois 61327.

The property will be sold provided the bid on each piece or parcel is equal to at least two-thirds of the valuation put on it, as shown by the report of the commissioner appointed by the court to make partition of the property, or the other pieces must sell for enough to make the total amount of the sales equal to two-thirds of the total amount of the valuation of all premises to be sold.

The premises will be first offered in separate tracts as follows:

1.      Tract #1 – The East Half of the Southwest Quarter of Section 11, Township 31 North, Range 1 West of the 3rd Principal Meridian, containing 81.955 acres, more or less, plus the East 8.532 acres, more or less, of the West Half of the Southwest Quarter of Section 11, Township 31 North, Range 1 West of the 3rd Principal Meridian.

2.      Tract #2 – The West Half of the Southeast Quarter of Section 11, Township 31 North, Range 1 West of the 3rd Principal Meridian containing 80 acres, more or less.

3.      Tract #3 - The East Half of the Southeast Quarter of Section 11, Township 31, North, Range 1 West of the 3rd Principal Meridian excepting the 7.35 acre homesite. Said tract containing 74.546 acres, more or less, after excepting the 7.35 acre homesite.

4.      Tract #4 – The West 20 acres of the Southwest Quarter of Section 12, Township 31 North, Range 1 West of the 3rd Principal Meridian, containing 20 acres, more or less.

5.      Tract #5 – That part of the East Half of the Southeast Quarter of Section 11, Township 31 North, Range 1 West of the 3rd Principal Meridian, known as the 7.35 acres homesite.

Then the said tracts will be offered in combinations, together with all improvements thereon; then said premises will be offered as a whole, and sold in whatever method produces the greatest return to the seller.

The premises will be sold by the sheriff in whichever method produces the greatest return to the seller. Kevin Doyle, Sheriff of Putnam County, Illinois is directed to make the sale and carry this judgment into effect and he is authorized to employ Joe Cotten as auctioneer on the terms heretofore set by this court and to procure evidence of title by way of commitment and title policy of Old Republic Title Insurance Company to deliver to buyer at the expense of the seller.

The sale will be made on the following terms:

10% of the purchase price, cash in hand on day of sale and the balance within 30 days after confirmation by the court of the report of sale upon delivery of sheriff’s deed, possession to the purchaser on March 1, 2008. The 2007 crops reserved to the seller and the 2007 taxes to be paid by the seller by deduction at closing based on 100% of the 2006 taxes, purchaser to pay 2008 taxes and subsequent taxes.

The premises will be sold in an “as is” condition, but with merchantable title free of all defects and encumbrances; subject to existing easements to public and quasi public utilities in and on said premises, zoning laws, the existing easements and dedications of public highways on said premises, mineral rights, rights of way of drainage ditches, drain tiles, feeders, laterals and underground pipes, if any, on said premises.

Survey:  The tracts have recently been surveyed at the seller's expense. A copy of the survey plat will be available for review at the auction. The said premises to be sold herein and the exceptions thereto are all pursuant to the plat of survey by Illinois Valley Surveying and Consultants, Inc., dated May 7, 2007.

Soil Map and Productivity Notes regarding the property:
Enclosed above is the Soil Survey Map and Legend for the property.

2006 crops consisted of 140.7 acres in corn and 179.8 acres in beans for a total of 320.5 acres under cultivation.
Yields in 2006 were 211.87 bushels per acre of corn, with a net of 200.45 per acre; soybeans yielded 52.3 bushels per acre.

There are no FSA payments on the property for the 2007 growing season. FSA farm #305, tract #469.
